1. Agreement & Universal Scope

By visiting our website or downloading, installing, accessing, or using any software application published by VX9Studio on Google Play, the Apple App Store, or any authorized distribution channel, you expressly agree to be bound by these Terms of Service and our Privacy Policies.

These Terms apply universally to all current mobile applications published by VX9Studio (including NextStep, Fennix, and AppRoute), as well as any future applications, alpha/beta test releases, widgets, developer tools, and associated online services developed or published under the VX9Studio brand.

If you do not agree with any part of these Terms, you must not access our website or download, install, or use any of our applications.

2. Privacy-First & On-Device Philosophy

VX9Studio specializes in privacy-conscious, client-side, and on-device mobile software. Unless explicitly stated in an application's specific documentation, our applications are engineered to process your personal routines, AI conversations, network configurations, and data locally on your device without transmitting private personal records to centralized cloud databases.

You acknowledge that offline-first and on-device architectures mean you are responsible for maintaining your device's backups and security, as we do not maintain centralized copies of your local database records.

3. Limited License & Intellectual Property

All applications, websites, source code, designs, algorithms, user interfaces, documentation, logos, trademarks, and intellectual property developed or published by VX9Studio remain the exclusive property of VX9Studio and its licensors.

Subject to your compliance with these Terms, VX9Studio grants you a personal, non-exclusive, non-transferable, revocable, limited license to download, install, and execute our applications on devices that you own or control for personal, non-commercial, or legitimate internal business utility.

You agree that you will not: (a) reverse engineer, decompile, disassemble, or attempt to derive source code from any compiled application binary; (b) modify, translate, adapt, or create derivative works of our applications; (c) bypass, disable, or tamper with any digital rights management, licensing mechanisms, or security features; or (d) rent, lease, sublicense, distribute, or publicly exhibit our applications without prior written authorization from VX9Studio.

4. Permitted Use & User Responsibilities

You agree to use our applications, services, and website solely for lawful purposes and in strict accordance with these Terms and all applicable regional, national, and international laws and telecommunications regulations.

Specifically, you agree that you will not:

• Interfere with, disrupt, or compromise the integrity, security, or normal operation of our website, backend APIs, or any third-party networks connected to our applications.

• Use our network routing or utility applications (such as AppRoute) to deliberately bypass carrier restrictions in violation of your cellular service agreements, conduct network denial-of-service activities, or intercept unauthorized communications.

• Use our on-device AI applications (such as Fennix) to generate, store, or transmit illegal, abusive, harassing, defamatory, or harmful content.

• Exploit, probe, or scan any vulnerability of our systems or attempt unauthorized access to restricted endpoints.

5. Mobile Device Permissions & System Services

Certain VX9Studio applications require system-level Android permissions to perform their core functionalities (such as VpnService for local packet routing and quota management in AppRoute, AlarmManager for persistent routine alerts in NextStep, or Foreground Services for background model processing in Fennix).

By enabling these permissions, you authorize the application to interact with your device's operating system in accordance with the application's stated feature set and Privacy Policy. You maintain full control to revoke these permissions at any time through your Android operating system settings, acknowledging that revoking permissions may impair or disable dependent features.

6. In-App Purchases, Billing & Subscriptions

Certain features, premium tiers, model downloads, or perpetual licenses across our current and future applications may be offered as in-app purchases or recurring subscriptions.

• Payment Processing: All in-app financial transactions are handled exclusively by authorized platform storefronts (primarily the Google Play Store via Google Play Billing). VX9Studio does not collect, receive, or store your credit card numbers, banking details, or billing addresses.

• Subscriptions & Renewals: Subscriptions automatically renew at the disclosed rate and frequency unless cancelled at least 24 hours prior to the conclusion of the active billing period. You may manage, modify, or cancel your active subscriptions at any time directly through Google Play Store > Payments & Subscriptions.

• Refunds: Refund requests for in-app purchases and subscriptions are governed strictly by the applicable policies of the Google Play Store or the respective storefront where the purchase was made.

7. Third-Party Services, Networks & APIs

Our applications and website may interact with or reference third-party software, mobile carriers, internet service providers, or cloud services (such as Firebase for crash diagnostics and analytics, Adapty and Google Play Billing for subscriptions, or optional external AI inference providers).

VX9Studio does not control, endorse, or assume responsibility for any third-party services, data network availability, carrier roaming charges, or external API uptime. Your interactions with third-party providers are subject to the respective terms and privacy policies of those providers.

8. Disclaimer of Warranties

To the fullest extent permitted by applicable law, all applications, websites, software, documentation, and services published by VX9Studio are provided strictly on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

VX9Studio expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, and accuracy of data.

We do not warrant that our applications will be uninterrupted, error-free, compatible with every device or operating system revision, immune to malicious disruption, or that any detected defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall VX9Studio, its founders, engineers, affiliates, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages—including but not limited to loss of profits, loss of data, loss of business goodwill, carrier overage charges, network throttling, or device malfunction—arising out of or in connection with your access to, use of, or inability to use any VX9Studio application or website.

In any circumstance, the aggregate liability of VX9Studio for all claims arising under or related to these Terms or any VX9Studio application shall be strictly limited to the amount paid by you, if any, for accessing or purchasing the specific application during the twelve (12) months preceding the event giving rise to liability, or ten United States dollars (US $10.00), whichever is greater.

10. Application Updates & Modifications

We reserve the right to deploy updates, patches, enhancements, or architectural modifications to our applications and website at any time without prior notice. Updates may be necessary to maintain software security, comply with platform requirements, or introduce new features.

We may also temporarily suspend, modify, or permanently discontinue any specific feature or application at our discretion without liability to you.

11. Termination

These Terms remain effective until terminated by either you or VX9Studio. You may terminate your agreement at any time by ceasing all use of our website and uninstalling all VX9Studio applications from your devices.

VX9Studio reserves the right to suspend, restrict, or revoke your license to use our applications or services immediately and without notice if you breach any provision of these Terms or engage in activities that threaten the security or integrity of our systems or other users.

12. Governing Law & Jurisdiction

These Terms of Service shall be governed by, interpreted, and construed in accordance with the substantive laws of Sri Lanka, without regard to conflict of law principles.

Any legal claim, dispute, or proceeding arising under or related to these Terms or any VX9Studio application shall be submitted to the exclusive jurisdiction of the competent courts of Sri Lanka, unless mandatory consumer protection regulations in your local jurisdiction require otherwise.

13. Changes to These Global Terms

We may revise and update these Terms of Service periodically to reflect changes in our legal obligations, platform policies, or application catalog. When updates occur, we will revise the "Last Updated" date at the top of this document.

Your continued use of any VX9Studio application or website following the publication of updated Terms constitutes your acceptance of the revised Terms.
